Welcome to Viwnex! These Terms of Service ("Terms") govern your access to and use of the Viwnex website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

Viwnex provides a unique educational platform designed to motivate learning through structured video courses and incentive programs. Users can subscribe to learning challenges, engage with embedded educational content (primarily from platforms like YouTube), and earn an incentive upon successful completion of specified learning objectives.

Acceptance of Terms

By registering for an account, accessing, browsing, or otherwise using the Service, you signify that you have read, understood, and agree to be bound by these Terms of Service. If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

User Accounts & Eligibility

Eligibility: You must be at least 18 years old to create an account and use the Viwnex Service. By using the Service, you represent and warrant that you meet this age requirement.
Account Registration: When creating an account, you agree to provide accurate, current, and complete information, including your mobile number. You are responsible for safeguarding your password and for any activities or actions under your password. Viwnex cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
Single Account Policy: Only one account is permitted per user. Creating or using multiple accounts (multi-accounting) is strictly prohibited and will lead to the permanent suspension of all associated accounts and forfeiture of any accumulated incentives.
Account Security: You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify Viwnex immediately of any unauthorized use of your account or any other breach of security.

Learning Challenges, Fees & Incentives

Learning Challenge Subscription Fee: To participate in our learning incentive program, you will pay a subscription fee of EX 10 units of currency. This fee grants you access to a structured learning path, curated educational content (primarily embedded from YouTube), progress tracking tools, and the opportunity to earn a completion incentive.
Completion Incentive: If you successfully complete the specified learning objectives (e.g., watching a required number or percentage of videos within the designated 30-day period and meeting any other stated criteria), you will receive a Learning Completion Incentive of 10 units of currency. This incentive is designed to motivate your commitment to learning.
Non-Completion of Challenge: If you do not meet the specified learning objectives within the 30-day period, the subscription fee of 10 units of currency will be retained by Viwnex. This retention compensates Viwnex for providing the organized learning content, platform tools, and the educational environment for the duration of the challenge period.
Withdrawal/Refund Policy: You may withdraw from a learning challenge at any time before the 30-day period ends. If you withdraw before fulfilling the completion criteria, your subscription fee will be returned to the original wallet/payment method used. Similarly, if you become inactive or fail to meet the criteria, the fee will be returned to the original wallet/payment method unless stated otherwise for specific programs. Viwnex reserves the right to review any refund request for security purposes before processing.
Advanced Paid Courses: In addition to the incentive programs, Viwnex offers advanced, independently paid courses. Participation in these advanced courses is optional and requires a separate payment. Details of these courses, including pricing and content, will be provided separately.
Taxes: You are solely responsible for any taxes that may apply to the incentives you receive from Viwnex. We encourage you to consult with a tax professional regarding your obligations.

Viwnex Revenue Model

Viwnex is a sustainable platform with a clear revenue model that supports its operations and incentive programs. Our primary sources of income include:

Advanced Paid Courses: Sales of our advanced and specialized courses that offer deeper learning and professional certifications.
Learning Challenge Subscription Fees: Fees from users who subscribe to our learning challenges but do not meet the specified completion criteria within the allotted time. These fees cover the costs of providing the platform, organizing content, and facilitating learning.
Platform Advertising & Partnerships: Revenue generated from displaying relevant advertisements on our platform and from strategic partnerships with educational institutions or content providers. (This applies if you have actual ads on your site beyond YouTube's, or specific partnership deals).

This diversified revenue strategy ensures the long-term viability of Viwnex and the integrity of our incentive programs.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Fraudulent Activity: Using automation software, bots, scripts, emulators, VPNs, proxies, or any deceptive methods to manipulate viewing progress, complete learning objectives, or circumvent any platform security measures. Viwnex employs advanced detection methods to identify and prevent such activities. Any confirmed fraud will result in immediate account suspension and forfeiture of any subscription fees or incentives.
Misrepresentation: Providing false or misleading information during registration or while using the Service.
System Abuse: Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
Intellectual Property Infringement: Reproducing, distributing, displaying, selling, transferring, or exploiting any content, code, or materials from the Service without explicit written permission from Viwnex or the respective rights holder, including any embedded content which remains the property of its original creators.
Harmful Content: Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Harassment & Spam: Harassing, annoying, intimidating, or threatening any Viwnex employees or other users. Sending unsolicited promotional or commercial content (spam).
Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any part of the Service.

Intellectual Property

All intellectual property rights related to the Viwnex Service, including its design, text, graphics, logos, software, unique course structures, and advanced proprietary courses, are owned by Viwnex or its licensors. While the basic educational video content may be embedded from third-party platforms like YouTube, Viwnex respects the intellectual property rights of these content creators. You may not copy, modify, distribute, sell, or lease any part of our Service or included content without explicit written permission.

Disclaimers & Limitation of Liability

Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Viwnex makes no warranties, express or implied, regarding the operation of the Service or the information, content, materials, or products included on the Service. We do not guarantee uninterrupted service, error-free operation, or that the Service will meet your specific learning outcomes or expectations regarding the completion incentive.
Limitation of Liability: To the fullest extent permitted by applicable law, Viwnex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Indemnification

You agree to defend, indemnify, and hold harmless Viwnex and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any third party.

Termination

Viwnex may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact support for assistance. In case of termination due to violation of these Terms, any active learning challenge subscription fees and accumulated incentives may be forfeited.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of iceland , without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of iceland .

General Provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Viwnex regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Viwnex.
